The contractual underpinning that makes all of this possible is rife with pitfalls and requires an application of best practices in order to help your client navigate the transaction successfully. This class provides a broad-ranging review of the history, key terms, and standard clauses and provisions that characterize all contracts, including Assignment and Novation, Performance, Breach, and how to terminate a contract in a legal and proper manner. This is followed by a practical survey of the contracts that are specific to real estate, including contract categories, listing agreements, broker and tenant representation agreements, and purchase offer agreements. The class also covers leases, sale contracts that only involve land, and some of the less-common but still important contracts for real estate.
