This 1-hour course on California laws and regulations fulfills the state elective requirement for annual renewal. Licensed mortgage loan originators in the state must take 8 hours of continuing education each year, with 3 hours being dedicated to federal law, 2 hours on ethics, 2 hours on non-traditional mortgage lending, and this 1 hour of state-specific content.
We’ll start with a review of the federal SAFE Act and California’s Residential Mortgage Loan Act and continue with a discussion of the regulatory structure for California Mortgage Loan Originators. The California Consumer Financial Protection law is explored, and then we’ll move on to important terms, definitions, and concepts in the state. We’ll define the different types of licensees, unlicensed activities, and who is and who is not an MLO.
The course then dives into the evolution of MLO requirements since the 2008 mortgage crisis, state requirements on remote workers, fee schedules, specific sections of the California Financial Code and penalties for noncompliance by licensees and others in the industry. The next portion of the course dives into the fiduciary mandates for mortgage brokers and MLOs and then explores agency and the authority of agents.
The last section of the course looks at new and revised legislation in the state. We’ll examine changes to conforming loan limits, what happens with mortgage loans when dissolution of marriage occurs, criminal and mortgage law fraud, changes to prepayment penalties, and how “flippers” must provide specific disclosures to consumers.
To promote comprehension, students will complete a 5-question quiz and short activity after each module. A 15-question final exam will wrap up the course.
